San Diego Mayor wants city to pay legal fees

(CNN) -- San Diego Mayor Bob Filner, who's battling a tide of sexual harassment allegations, wants his city to cover his legal expenses.

Last week, Filner's lawyer sent a letter to the city, saying it should mount the mayor's defense and pay his legal bills.

On Tuesday, the city council will hold a closed session to figure out how to proceed.

It's a tricky predicament.

Seven of nine members of the city council have asked Filner to step down.

And even though it's not unprecedented for cities to pick up the tab to defend one of its officials, some city council members have said Filner's case is different: the acts he's accused of didn't take place as part of his official duties.

There's also another hitch: the city itself, along with the mayor, is the defendant in a lawsuit filed by his former spokeswoman -- one of seven women accusing Filner of unwanted groping, kissing or other inappropriate contact.

Irene Jackson filed her suit against Filner, saying she and other women were subjected to his "crude and disgusting" comments and inappropriate touching.

She said she resigned as Filner's communications director in June after deciding that the mayor would not change his behavior.

Filner, 70, says he will enter a behavior counseling clinic next month for two weeks of "intensive therapy." But, he has repeatedly said he will not step down from an office he was elected to barely eight months ago.

San Diego's city charter does not require him to appoint an interim mayor for a temporary absence.

His decision is unlikely to quell the mounting calls for his resignation.

Many of the accusations allegedly took place during his five terms in Congress, before he was elected mayor last year.

In response, Filner's chief of staff resigned, the Democratic Party of San Diego voted to call for his resignation -- even his fiancee left his side.

A group began an official recall effort but political observers have expressed doubt that the group can logistically pull off collecting the more than 100,000 signatures needed.

97% Before Midnight

The Before series has steadily gotten better as it goes along, which is more than any but the most optimistic among us dare to hope for from love.

Before Midnight is the fullest and richest and saddest of the three movies in the trilogy.

the actual give-and-take between the characters is uncomfortably emotionally accurate, which means it will make an excellent, if challenging, date movie for both new and old couples.

If I were only allowed to see one movie this year, I'd want it to be Before Midnight. If I were only allowed two trips to a theater this year, I'd see it twice.

It's a wildly uneven enterprise, overall.

If anything, the films have only gotten better by letting the relationship marinate. "Midnight's" more disgruntled edge reflects what creeps up on couples as years pass, regrets stack up, kids factor in, real life intervenes.

Ethan Hawke and Julie Delpy come off as if they were conjoined for the past nine years in the gloriously-acted, hypnotically-conversational conclusion to the Before Sunrise trilogy -- the year's first legit contender for awards season love.

The last 40 minutes consisting of acute, sharp, and biting dialogue reminiscent of 'Who's Afraid of Virginia Woolf' make sitting through the excruciating first hour worth it.

Brilliant, mature third chapter to heartfelt romantic saga.

Truth is beauty, and beauty truth, but they're not necessarily romantic nine years into a serious committed relationship with two kids in the backseat.

No matter how long the gap between movies has been or how completely the characters' lives have changed, when Jesse and Celine turn to each other and start one of their famously epic conversations, it feels like no time has passed at all.

A life-affirming, emotionally captivating and rewarding experience. It treats the audience like sophisticated, mature adults---a demographic that has been sorely neglected by Hollywood nowadays.

The combination of high-level performance and subtle construction, in a picture in which nothing blows up, is actually thrilling.

While not the most fun or sexiest film in this trilogy -- do you want to watch mom and dad fight for 30 minutes straight? -- it's easily the most necessary, and it's the logical extension of where this relationship story should and must go.

The actors have mastered these roles, and Linklater's observational style is so perfected that they could go on speaking for hours

You feel how much is at stake when they argue, how real the damage they inflict, and you can't shake it off. It's a spectacular movie.

Such is the power of the final scenes that the trio would be more than justified in launching a fourth film sometimes in the next five years or so.

Fireworks of authentic dialogue, emotion, and the madness of love reach a crescendo of palpable joie de vivre in "Before Midnight."

Bahrain explosion injures 7 policemen

MANAMA, Bahrain (AP) ? Bahraini police said they arrested three suspects Thursday over a bombing the previous night that wounded seven policemen and that was described as a "terrorist" attack in the violence-wracked Gulf kingdom.

Police have been targeted before during the more than two-year unrest on the strategic island nation, which is home to the U.S. Navy's 5th Fleet.

But the blast late Wednesday, using what was called a homemade device, was among the most police casualties in a single attack. The attack occurred in Bani Jamra, the site of frequent clashes about 10 kilometers (six miles) west of the capita, Manama.

Bahrain's Interior Ministry said three suspects were in custody and the investigation was ongoing. At least two of the policemen were reported to be in critical condition.

More than 60 people have been killed since Bahrain's majority Shiites began an Arab Spring-inspired uprising for a greater political voice in the Sunni-ruled nation.

With May coming to an end in just a few days, so is National Home Improvement Month. If you weren't aware of the 31-day fete dedicated to facelifts for your home, do not fret. If you ask me, any day is a good day to repair and restore all that is rusted and in need of retirement in and around your humble abode.

One my favorite rooms in a home is the bathroom. According to Dumel, consumers who walk into Frank Webb are looking for their dream bathroom -- a vision that often leads them to designing a resort-style retreat. "A majority of people get their inspiration from hotels and want build the same bathroom in their home," Dumel said.

With 15 years of design experience under her belt, Dumel offers consumers expert advice on anything from flooring and fixtures to lightening and limestone. A top trend she is witnessing in bath remodels this season is the transition from a dual bath and shower stall to a standing tile shower. With tile adding to a bathroom's d?cor aesthetic and a standing shower adding square footage to an often petite space, there's much to be envied. Consumers, Dumel added, are also installing luxury amenities to their shower such as steam.

Color choice is also important as it pulls a room together. Consumers are forgoing the once popular Earth tones for sleek grays, metallics and whites when picking paint and tile. Chrome faucets and glass shower doors are also gaining momentum as both offer a contemporary look and are easy to maintain.

Music streaming, gaming among new Google services

SAN FRANCISCO (AP) ? Google's sixth annual conference for software developers opened Wednesday with a chance for the company to showcase the latest mobile devices running its Android software, while also unveiling other features in its evolving product line-up. Announcements include new tools for online games and a music-streaming service that will allow Android users to listen to their favorite songs and artists for a monthly fee.

The audience of about 6,000 people at "Google I/O" includes engineers and entrepreneurs who develop applications and other features that can make smartphones and tablets more appealing. Reporters from around the world also will be on hand, giving Google a chance to generate more hoopla about its latest innovations.

Android already has been activated on 900 million devices made by Samsung Electronics Co., HTC Corp. and other manufacturers. Android devices are the chief rivals to Apple's iPhones and iPads. Android has helped Google make more money because its search engine and other services, including maps, are usually built into the devices. That tie-in drives more visitors to Google and gives the Mountain View, Calif., company more opportunities to sell ads.

Much of the speculation about the conference has centered on a possible upgrade to the Nexus 7, a mini-tablet that debuted at last year's event.

Google also may provide more insights into the popularity of Google Plus, a social networking alternative to Facebook that launched nearly two years ago. In an attempt persuade more people to use Google Plus more frequently, Google has promised to keep adding tools that aren't available on Facebook.

Google's conference was being held at the Moscone Center in San Francisco.

The keynote kicked off at about 9 a.m. PDT and was expected to last nearly three hours. The conference goes through Friday.

Presenters include Vic Gundotra, Google's senior vice president for engineering; Sundar Pichai, the head of Google's senior vice president for apps and the Chrome operating system for laptops; Hugo Barra, vice president for product management at Android; and Ellie Powers, a product manager at Google.

Google unveils a music service called All Access. The streaming service will allow Android users to listen to their favorite songs and artists for a monthly fee.

Google wants to not only offer access to millions of songs, but also help guide you to music you might like. You can choose one of 22 music genres and see key albums that define the genre along with recommendations from Google's curators. You can listen to any track right away, or switch to a "radio station" format featuring songs you'll likely want to hear. You can adjust the playlist as you go.

The cost is $9.99 a month in the U.S., after a 30-day free trial. It launches in the U.S. Wednesday. If you start the trial by June 30, the monthly fee will drop to $7.99. It will be available in other countries later.

Google's All Access will be competing with Spotify and other popular music services.

Google says its online Play store will make recommendations for apps, books, movies and music based on the device you are using. After all, what works well on a tablet might not on a phone.

Powers introduces a service to help software developers get more users and make more money through their apps.

It will tell a developer, for instance, that an app is particularly popular in Russia, so that the developer could consider making a Russian-language version. Google is offering an app-translation service to help with that.

Another feature is designed to help developers understand how effective their ads are in getting people to download their apps.

Google unveils a tool to help software developers make sure their apps work well on different screen sizes. That's important because some people use phones and others use mid-size or larger tablets. Developers will want to make sure their apps are pleasant across the board.

9:25 a.m.

Google introduces a technology for syncing notifications on different devices. The idea is when you dismiss a notification about a new Facebook message, for instance, it wouldn't reappear when you check your tablet.

Google also unveils new gaming tools. You can save where you are in a game and pick up on another device. You can also see how you rank on new leaderboards. This appears similar to what Apple offers on iPhones and iPads through its Game Center. Getting into gaming gives Google an opportunity to participate in one of the most popular activities on mobile devices.

Barra introduces a few tools for software developers to incorporate into their apps. One allows apps to track what users are doing, such as walking. It may appear creepy to users, but Barra says the tools will allow developers to create "a whole new category of awesome apps."

Pichai talks about Google having two large, fast-growing platforms: Android for smartphones and tablets and Chrome for laptops.

He says Android has grown from being on 100 million devices in 2011, 400 million in 2012 to 900 million now. He calls the growth "extraordinary." He suggests there's still room for growth with 7 billion people in the world.

Florida Senate plan would clear way for trauma centers

A Senate committee Thursday approved proposals that could make it easier to open new hospital trauma centers ? and assure that some disputed trauma centers would remain open.

Plunging into a debate about Florida?s trauma system, a Senate committee Thursday approved proposals that could make it easier to open new hospital trauma centers ? and assure that some disputed trauma centers would remain open.

The Senate Appropriations Committee took up a health-care bill (SB 966) and made changes that could help fast-track new trauma centers in four regions of the state and also protect trauma centers that have been embroiled in a series of legal challenges.

Bill sponsor Aaron Bean, R-Fernandina Beach, said lawmakers are trying to make sure people have access to trauma care within what he called the ?golden hour? after accidents.

?Are you within the golden hour to make it alive to a hospital??? he asked.

But the proposals, which popped up as part of a 128-page amendment to the bill and two subsequent amendments, drew criticism from teaching hospitals and safety-net hospitals that provide trauma care. Mark Delegal, a lobbyist for the Teaching Hospital Council of Florida, said the proposals had not been considered by health-care committees that ordinarily would debate such ideas.

?This is the kind of stuff that those of us who work in this process should not do,?? Delegal said.

The move by the Appropriations Committee came two days after a House panel also approved a bill to overhaul the way trauma centers are approved. But the Senate version appears to be more far-reaching.

In part, it would create a special approval process for trauma centers in four regions that it describes as having ?limited access to trauma care services.? As an example, one of those regions is in the western Panhandle, where Fort Walton Beach Medical Center has been trying to get approval to open a trauma center.

Sea-ice ecosystem possibly triggered evolution of baleen whales and penguins

Frankfurt/Main, Germany, April 18, 2013. The circum-Antarctic Southern Ocean is an important region for global marine food webs and carbon cycling because of sea-ice formation and its unique plankton ecosystem. The origin of its ecosystems can be traced back to the emergence of the Antarctic ice sheets approximately 33.6 million years ago. This discovery was made by an international team including scientists from the Goethe University and the Biodiversity and Climate Research Centre in Frankfurt, Germany. Their study, published today in Science, shows that the development of the sea-ice ecosystem possibly triggered further adaptation and evolution of larger organisms such as baleen whales and penguins.

The scientists analysed sediment samples from drill cores on the seafloor, which were obtained in 2010 off the coast of Antarctica, as part of the Integrated Ocean Drilling Program (IODP). The cores reach nearly 1000 meters beneath the seafloor and provide new insights into a long gone past.

A study published in 2012 demonstrated that subtropical plants covered Antarctica about 53 million years ago. In the course of the following 20 million years, the global climate cooled continuously. The new study focuses on the interval 33.6 million years ago when within a short time an enormous ice sheet covered Antarctica. This changed the life conditions and the ecosystems on the Antarctic continent and the surrounding Southern Ocean dramatically.

Tiny witnesses: Dinoflagellates

The ocean plankton mainly consist of algae, most of which are not preserved in sediment samples from drill cores. In contrast, single-celled dinoflagellates, a group of algae containing organic fossilizable substance, do preserve in sedimentary sequences over millions of years. This makes them a valuable tool to reconstruct environmental.

The researchers found that when Antarctica was sub-tropical and ice-free, the surrounding seas were inhabited by a diverse array of dinoflagellates characteristic for relatively warm climates. However, from the moment that the ice cap formed, the diversity suddenly collapsed, and from that moment, only species occurred that are adapted to temporary sea-ice cover and characterize modern sea-ice environments around Antarctica. They are present in high numbers only when the sea ice melts in spring and summer, and therefore are available as a food source for higher organisms only during a short period of the year.

New species due to food shortage

The seas around Antarctica play a critical role in the food web of the ocean. Algal blooms only occur in summer, when the sea ice melts. These blooms are a key food source for both small single-cell organisms such as certain species of dinoflagellates and for larger organisms.

"The sudden turnover in the dinoflagellate assemblages indicates clearly that the entire plankton ecosystem of the Antarctic waters had changed", explains Prof. Jrg Pross, co-author of the study and paleoclimatologist at the Goethe University and the Biodiversity and Climate Research Centre (BiK-F) in Frankfurt, Germany. "The explosion of dinoflagellates adapted to a temporary sea-ice cover testifies to an in-depth reorganization of the food web in the Southern Ocean."

Larger animals higher up in the ocean's food chain probably adapted their diet because the algal growth season became shorter and more intense. Jrg Pross sums up: Our data suggest that this change may have promoted the evolution of modern baleen whales and penguins". These results stress that major climate change is often accompanied by particularly rapid biological evolution.

06 April 2013, AFP - Oil prices slumped overnight after new data showed lofty supplies of US crude, suggesting weak demand in the world?s biggest economy.

US crude benchmark West Texas Intermediate for May delivery closed at $US94.45 ($90.12) a barrel, down $US2.74, or 2.8 per cent.

European benchmark Brent oil for May delivery settled at $US107.11, down $US3.58 a barrel, or 3.2 per cent.

The sharp declines came as the weekly inventory report from the US Energy Information Administration showed US crude reserves rose 2.7 million barrels to 388.6 million barrels.

That was far bigger than market expectations of a gain of 1.5 million barrels, according to analysts polled by Dow Jones Newswires.

The report also showed only a modest decline of 600,000 barrels of gasoline stocks, slightly more than the draw seen by analysts.

Stephen Schork, an analyst with the Schork Group, attributed the drop in crude oil to a retreat in gasoline prices in recent days.

?Inventories are comfortable,? Schork said, adding that oil refineries are coming out of maintenance season. ?So our ability to make even more gasoline will increase in the weeks ahead.?

The US private sector added just 158,000 jobs in March, according to payrolls firm ADP, well below the estimate of 197,000 seen by analysts.

Growth in the US services sector also slowed in March, according to data from the Institute for Supply Management. The ISM said the non-manufacturing purchasing managers index fell to 54.4 in March, down from 56 in February.

?The inventory report is overlapping with a little bit of economic uncertainty? after the weak ISM report, said Gene McGillian, analyst and broker at Tradition Energy.

Bart Melek, head of commodity strategy at TD Securities, said the oil market was also reacting to speculation of a possible agreement between Western powers and Iran over Iran?s nuclear program.

Tensions with Iran have boosted oil prices in recent months due to concerns over Iran?s threat to blockade the Strait of Hormuz, a critical transport waterway for oil.

BlackBerry posts surprise profit, but subscriber base down

TORONTO (Reuters) - BlackBerry reported a surprise quarterly profit on Thursday and said it shipped 1 million of its all-new Z10 smartphones in the period, but the company has yet to convince some investors that its turnaround plan is succeeding.

The Canadian smartphone maker's shares were up nearly 2 percent in early trading, but had jumped of more than 10 percent immediately after the results came out. Some investors focused on a decline in the company's subscriber base, a possible threat to its long-term growth prospects.

Still, the results offered solace to both bulls and bears on BlackBerry, which virtually invented on-your-hip email, but has lost market share to iPhone maker Apple and smartphones using Google Inc's Android software.

"I think the 1 million units is a nice start," said Morningstar analyst Brian Colello. "I think the encouraging thing is that BlackBerry was still able to sell a good portion of older models and generate solid service revenue during the transition. I think that will be important in terms of cash balance and profitability."

The touchscreen Z10, which uses an all-new operating system, is key to BlackBerry's revival. Its introduction a month before the end of the quarter received a warm reception in Canada and a few other countries, but the initial U.S. launch, just last week, was muted.

Some analysts said revenue missed expectations and that the decline in subscriber numbers to 76 million from 79 million during the fourth quarter ended March 2 clouded BlackBerry's long-term turnaround prospects.

The stock was up 1.9 percent at $14.83 in early trading on Nasdaq.

BREAK-EVEN FORECAST

BlackBerry said Mike Lazaridis, who co-founded BlackBerry nearly 30 years ago, would step down as vice chairman and director. Lazaridis was co-chief executive officer until last year.

The company also surprised investors by saying it believes it will approach break-even financial results in its first quarter, based on a lower cost base, more efficient supply chain and improved hardware margins.

Analysts on average had expected a loss of 10 cents a share in the first quarter, according to Thomson Reuters I/B/E/S.

BlackBerry said net income in the fourth quarter was $98 million, or 19 cents a share, compared with a year-earlier loss of $125 million, or 24 cents a share.

Excluding one-time items, the company reported a profit of 22 cents a share. Analysts had expected a loss.

Yet the company is not out of the woods. Quarterly revenue fell to $2.68 billion from $4.2 billion a year earlier, below analysts' estimates of $2.84 billion.

"All in all, I'm happy because I think the majority seemed to be expecting the world to cave in on them, and that did not happen," said Eric Jackson, founder and managing partner of Ironfire Capital LLC, which owns BlackBerry shares.

Discovery may allow scientists to make fuel from carbon dioxide in the atmosphere

Mar. 26, 2013 ? Excess carbon dioxide in Earth's atmosphere created by the widespread burning of fossil fuels is the major driving force of global climate change, and researchers the world over are looking for new ways to generate power that leaves a smaller carbon footprint.

Now, researchers at the University of Georgia have found a way to transform the carbon dioxide trapped in the atmosphere into useful industrial products. Their discovery may soon lead to the creation of biofuels made directly from the carbon dioxide in the air that is responsible for trapping the sun's rays and raising global temperatures.

"Basically, what we have done is create a microorganism that does with carbon dioxide exactly what plants do-absorb it and generate something useful," said Michael Adams, member of UGA's Bioenergy Systems Research Institute, Georgia Power professor of biotechnology and Distinguished Research Professor of biochemistry and molecular biology in the Franklin College of Arts and Sciences.

During the process of photosynthesis, plants use sunlight to transform water and carbon dioxide into sugars that the plants use for energy, much like humans burn calories from food.

These sugars can be fermented into fuels like ethanol, but it has proven extraordinarily difficult to efficiently extract the sugars, which are locked away inside the plant's complex cell walls.

"What this discovery means is that we can remove plants as the middleman," said Adams, who is co-author of the study detailing their results published March 25 in the early online edition of the Proceedings of the National Academy of Sciences. "We can take carbon dioxide directly from the atmosphere and turn it into useful products like fuels and chemicals without having to go through the inefficient process of growing plants and extracting sugars from biomass."

The process is made possible by a unique microorganism called Pyrococcus furiosus, or "rushing fireball," which thrives by feeding on carbohydrates in the super-heated ocean waters near geothermal vents. By manipulating the organism's genetic material, Adams and his colleagues created a kind of P. furiosus that is capable of feeding at much lower temperatures on carbon dioxide.

The research team then used hydrogen gas to create a chemical reaction in the microorganism that incorporates carbon dioxide into 3-hydroxypropionic acid, a common industrial chemical used to make acrylics and many other products.

With other genetic manipulations of this new strain of P. furiosus, Adams and his colleagues could create a version that generates a host of other useful industrial products, including fuel, from carbon dioxide.

When the fuel created through the P. furiosus process is burned, it releases the same amount of carbon dioxide used to create it, effectively making it carbon neutral, and a much cleaner alternative to gasoline, coal and oil.

"This is an important first step that has great promise as an efficient and cost-effective method of producing fuels," Adams said. "In the future we will refine the process and begin testing it on larger scales."

The research was supported by the Department of Energy as part of the Electrofuels Program of the Advanced Research Projects Agency-Energy under Grant DE-AR0000081.

Head of Chadian army claims troops kill Belmoktar

N'DJAMENA, Chad (AP) ? The head of Chad's military has announced on state television that Chadian troops deployed in northern Mali killed Moktar Belmoktar, the international terrorist responsible for the attack on a natural gas plant in Algeria that resulted in the death of dozens of foreigners. The French military, which is leading the offensive in northern Mali, says it cannot confirm the information.

Army Chief of Staff Gen. Zakaria Ngobongue read a statement saying Chadian soldiers on Saturday had destroyed a jihadist base in the Adrar and Ifoghas mountains of North Mali, killing Belmoktar.

The purported death of Belmoktar comes a day after Chad's president said their troops killed Abou Zeid, the other main al-Qaida commander in the region, a claim the French also said they could not confirm.

Exit polls: Swiss OK tough limits on bosses' pay

BERLIN (AP) ? Exit polls show Swiss voters have approved a measure to boost shareholders' say on executive pay.

The "Rip-off Initiative" is designed to prevent bosses from receiving huge bonuses even when their companies do badly.

The head of polling group gfs.bern, Claude Longchamp, told Swiss public television station SRF that 68 percent of voters backed the measure and 32 percent voted.

If Sunday's exit polls prove correct, parliament will have to draft a law giving shareholders the right to hold a binding vote on all compensation for company executives and directors. The law will also ban signing and leaving bonuses for senior managers and push greater corporate transparency.

Breaching the rules could lead to a fine of up to six annual salaries and up to three years in prison.

1 dead in shooting outside rapper's bus in Philly

PHILADELPHIA (AP) ? Philadelphia police said they were looking Friday for anyone who may have seen someone in a black, four-door sedan with tinted windows fire shots into a crowd of people surrounding the tour bus of rapper French Montana, killing one person and injuring another.

The shooting happened late Thursday night as the bus, followed by several cars with other friends and family, arrived at a hotel near Penn's Landing for a post-concert party after the rapper had headlined a sold-out show at the Theatre of Living Arts.

Homicide Capt. James Clark said the sedan pulled up and someone fired shots into the crowd from a passenger side window. Two people in the crowd fired back, Clark said, and police were mulling whether to file charges against them. The rapper and members of his entourage were being interviewed at police headquarters and are cooperating in the investigation, but police don't know if they were targeted, Clark said.

Investigators are looking for witnesses and searching for any surveillance footage that may provide clues.

"We believe someone saw something," he said. "It could have been a lot more tragic."

The man killed was identified by police as 26-year-old Jowann King, of Flushing, N.Y. Police did not release the name of the man who was injured.

The Moroccan rapper, born Karim Kharbouch, posted a photo on Twitter showing a police officer interviewing a person after the shooting, and also posted photos of himself with Philadelphia rapper Meek Mill at the show. The New York artist is scheduled to play Brighton Music Hall in Boston on Friday night and is touring to promote his upcoming debut album, "Excuse My French," which features Nicki Minaj.

Mill was on the tour bus Thursday night, Clark said.

Last month, three people were killed and five injured in a shootout and crash on the Las Vegas strip; police think that shootout may have started as an argument at the valet area of the upscale Aria resort-casino the same night French Montana was playing at Aria's signature nightclub, Haze.

A message left by The Associated Press for the artist's publicist was not immediately returned.

Earlier this month I was chosen to be one of a dozen bloggers invited to Experience Kissimmee. Five days and four nights we took in local sites?some world famous and some less known.

Welcomed at Westgate, we each enjoyed the comforts of our own private villa, the hospitality of the resort, its Decade of Memories contest kickoff, its super Superbowl XLVII party, and more. But don?t think we just stayed on property. The Kissimmee locale is more than just theme parks. With Pegasus as transport, Day One itinerary includes Wild Florida and Forever Florida, breathtaking vistas as well as Old Town, a memory lane entertainment/shopping experience.

We begin our day at Wild Florida. Its Florida?s Lake Cypress location is a protected swamp. Look at me. I don?t believe I am actually holding a three year old alligator. Can?t find a better place to safely watch birds, eagles, and gators in their true environment. Plus its on property nature preserve allows visitors to see deer, zebra, watusi, water buffalo, emu, and boar roam. Anyone who knows me knows I love who-dun-its and two of my all time favorites are Miami Vice and CSI Miami. Their airboat chase scenes are awesome. So when I learn that I will be touring Central Florida?s Everglades in one, what an adventure, what an eco trip, what a rush!

All aboard. Next stop is St. Cloud?s Forever Florida. Its Allen Broussard Conservatory offers, ziplining, nature tours, and horseback tours. Most of the group is ziplining. Can you imagine yourself moving at speeds of 30 mph over the treetops, 68 feet above the ground? I opt out because of a work injury. Instead I send my camera to record the aerial tour?s breathtaking vantages. I content myself with an open-air coach safari ride five feet above this Florida ecosystem?s flora and fauna. I enjoy the unspoiled beauty of the day, the horses, and the land.

Dusk is falling. On to Old Town, dinner, classic stock (25 year old+) car cruising, and Chocolate Kingdom?s factory tour. I found its exhibits interesting. Do you know that the use of cacao dates back to 1100-1400 BC? I customize a dark chocolate bar rather than a white or milk one then opt for an assortment of nuts instead of fruit and/or spice additives. I plan to give it to hubby BUT, alas, its fresh smell tempts me to nibble, and nibble, and nibble. What a bedtime snack!

Bishop visits Hampshire village to rededicate church

THE Bishop of Winchester recently visited one of Hampshire?s smallest villages to lead a special service.

The Rt RevTim Dakin conducted a celebration and re-dedication of East Stratton?s All Saints? Church following completion of a ?200,000 restoration project of the Grade 2 listed building.

On Sunday, February 17, after the morning service, the bishop joined local dignitaries and parishioners in the village hall for drinks and lunch.

The service was the culmination of three years work by residents of East and West Stratton, who raised the necessary funds.

Church warden, Chris Hilling, said: ?Given that East & West Stratton number only about 70 households, this has been a truly remarkable achievement and shows what can happen when a local community throws its weight behind a project.?

The Hampshire Chronicle reported in 2009 how Lord Northbrook had set up an appeals committee to save the church, which required urgent repairs to the roof, tower and churchyard wall.

The committee raised over ?40,000 from events within the parish, supplemented by various grants from charities, as well as English Heritage.

Lord Northbrook said: ?We are indebted both to English Heritage for their generous grants, without which we could not have restored our church, and to Patrick Craze, a resident of East Stratton, for his unstinting work in securing all our grants and in managing the restoration works.?

NCAA acknowledges 'missteps' in Miami case

CORAL GABLES, Fla. (AP) -- Calling the NCAA's investigation "unprofessional and unethical," Miami President Donna Shalala lashed out at the governing body for college athletics on Monday, insisting that their long probe of the Hurricanes not only come to a swift end but result in no other penalties against her school.

"We have been wronged," Shalala said.

Her statement came shortly after the embattled NCAA said it was pressing on with the case against Miami, even after the acknowledgment Monday of "missteps" that led to the replacement of its enforcement department and the throwing out of all ill-gotten information gleaned from two depositions that could have been very damaging for the Hurricanes.

The NCAA said it paid Maria Elena Perez, the attorney for former booster Nevin Shapiro, more than $19,000 for work she performed, primarily using subpoena power to ask questions on the association's behalf and doing so under the guise of a bankruptcy case. The NCAA does not have subpoena power and was not involved in Shapiro's bankruptcy proceedings.

And this all comes with Miami expecting to finally receive its notice of allegations - the list of wrongs that the NCAA will claim it found - as early as Tuesday, a long-awaited step that will usher in the start of the sanction phase of the process.

"Sadly the NCAA has not lived up to their own core principles," Shalala wrote. "The lengthy and already flawed investigation has demonstrated a disappointing pattern of unprofessional and unethical behavior. By the NCAA leadership's own admission, the University of Miami has suffered from inappropriate practices by NCAA staff."

Perez did not immediately respond to a request for comment. The Florida Bar said last week that it has opened a file to see if Perez broke any rules through her involvement in the Miami-NCAA matter.

Earlier Monday, speaking on a teleconference to announce the findings of a review into his association's ties with the attorney of the former Miami booster at the center of this scandal, NCAA President Mark Emmert insisted the case will not be settled.

"This is going to go forward to the committee on infractions," Emmert said.

It's believed that committee has a meeting sometime in the next few days, though it would be an incredibly rare step for Miami to get in front of that group so quickly. The next scheduled session comes in April - and it usually takes two to three months for penalties to be announced after schools appear before that committee.

"There must be a strong sense of urgency to bring this to closure," Shalala wrote. "Our dedicated staff and coaches, our outstanding student-athletes, and our supporters deserve nothing less."

Already, Miami's football program has voluntarily forfeited the right to appear in two bowl games, along with one trip to the Atlantic Coast Conference championship game, up to 30 practices and an undisclosed number of scholarships in response to the investigation. Earlier this month, coach Al Golden told The Associated Press that he believes the Hurricanes have already paid "a huge penalty."

Others, on the NCAA level, are also paying a price.

Julie Roe Lach, who was the NCAA's vice president for enforcement - basically, its top cop - since 2010, was ousted and has been replaced on a temporary basis by Jonathan Duncan, a lawyer with extensive experience working with the association.

"Obviously, this is an outcome that nobody wants to see on their watch or anyone else's," Emmert said. "This is something that's an embarrassment to the association and our staff."

Lach was part of the chain that approved payments to Perez, the attorney for Shapiro, a convicted Ponzi scheme architect now serving a 20-year term in federal prison. According to a 52-page report commissioned by the NCAA and released Monday, Perez offered her help to the NCAA in the form of "using bankruptcy subpoenas to compel depositions from witnesses who had refused to cooperate."

The NCAA, in turn, provided her with specific questions to ask, those coming in an email from former investigator Ameen Najjar, dated Dec. 18, 2011. "Maria, Listed below are a number of areas we would like you to explore," began the email from Najjar.

From there, he listed 34 questions, none of which seem to be in any way related to a bankruptcy case.

Upon learning that Perez was willing to participate with investigators, members of the NCAA's legal team urged the enforcement department not to proceed, though were apparently ignored. And now the depositions given by former Miami equipment-room staffer Sean Allen and former Shapiro business partner Michael Huyghue - along with any other lead that came out of their interviews - have been tossed from the NCAA's case against the Hurricanes.

"Based upon our review, it is our opinion that the current assertions in the U. Miami Investigative Record are not based on evidence that is derived, directly or indirectly, from the depositions of Mr. Allen or Mr. Huyghue," said the report, which was prepared by Kenneth L. Wainstein, an attorney hired to lead the probe that Emmert ordered last month.

Wainstein estimated on a teleconference that about 20 percent of the case against Miami had to be tossed because of the depositions.

According to the report and other documents released by the NCAA on Monday, Perez billed the NCAA for $57,115 worth of work performed from October 2011 through July 2012 - though Lach and other officials were expecting the amount of her work to cost roughly $15,000. The depositions of Allen and Huyghue were performed in December 2011.

One email released by the NCAA from an investigator who worked on the case said they wanted her to depose Allen because the NCAA "did not think he would interview with us again" otherwise.

Allen was not contacted during the NCAA's external probe, which started late last month after Emmert said major breakdowns in the association's own procedures were discovered.

Another point in the report was that now-retired Associate Director of Enforcement Rich Johanningmeier bought a prepaid cellphone and paid for Shapiro's prison phone calls. The NCAA spent about $8,200 "to fund communications with Mr. Shapiro, including transfers of approximately $4,500 to his prison commissary account."

Given what the NCAA revealed Monday, Shalala made it very clear: Miami will not accept more sanctions without a fight.

"We believe that this process must come to a swift resolution, which includes no additional punitive measures beyond those already self-imposed," Shalala said.
